Welcome to The Imaginarium, owned and operated by Erik Goodwyn ("we," "us," or "our"). By accessing or using our Site, making a purchase, or interacting with our services, you (the "User" or "Customer") agree to be bound by the following Terms and Conditions. 1. Eligibility & Accounts

  • Age Requirement: By purchasing from this Site, you affirm that you are at least 18 years old, or the age of majority in your jurisdiction, or have parental consent to use this Site.

  • Account Security: If you create an account, you are solely responsible for maintaining the confidentiality of your login credentials. You agree to accept responsibility for all activities that occur under your account. We reserve the right to terminate accounts or refuse service at our sole discretion.

 

2. Intellectual Property Rights

  • Content Ownership: All text, book descriptions, graphics, logos, button icons, custom apparel/merchandise designs, illustrations, photography, and digital downloads on this Site are the property of The Imaginarium or its content suppliers and are protected by copyright and intellectual property laws.

  • Limited License: You may not copy, reproduce, resell, modify, or distribute any content or product designs from this Site without explicit written permission from us.

 

3. Products, Pricing, and Modifications

  • Product Descriptions: We attempt to display the colors, textures, and details of our books and merchandise (such as mugs, clothing, and prints) as accurately as possible. However, we do not warrant that product descriptions or images are 100% accurate, complete, or error-free.

  • Pricing & Availability: All prices are subject to change without notice. We reserve the right to modify or discontinue any product or service at any time. We are not liable to you or any third party for price changes or product unavailability.

  • Order Rejection: We reserve the right to limit or refuse any order you place with us. This may include orders placed under the same customer account, credit card, or shipping address.

 

4. Payments and Billing

  • Payment Methods: You agree to provide current, complete, and accurate purchase and account information for all checkout transactions. We accept payment via Visa, Mastercard, PayPal, Apple Pay, and other digital methods.

  • Taxes and Duties: Prices listed may not include shipping or applicable sales tax. You are responsible for any sales taxes, customs, or import duties levied on your order based on your shipping destination.

 

5. Shipping and Delivery

  • Fulfillment: Shipping and delivery windows are estimates only and cannot be guaranteed. Risk of loss and title for physical items pass to you upon our delivery to the shipping carrier.

  • Print-on-Demand/Merchandise: Certain merchandise items may be printed on demand and fulfilled via third-party partners. These items may ship separately from book orders.

 

6. Digital Products & Downloads

  • License for Digital Goods: Upon purchasing an e-book or digital download, you are granted a non-exclusive, non-transferable, personal license to view and read the item.

  • Prohibited Sharing: You may not share, distribute, resell, or upload the digital files to external networks, file-sharing sites, or public forums. Unauthorized distribution constitutes copyright infringement.

 

7. Returns, Refunds, and Cancellations

  • Physical Items: We offer a 14-day return policy for physical books and unused merchandise in its original condition. Return shipping costs are the responsibility of the Customer.

  • Digital Goods: Due to the immediate delivery nature of digital products (e-books, digital downloads), all digital sales are final and non-refundable unless the file is proven corrupted or defective.

8. User Content and Reviews

  • Public Comments: If you post book reviews, comments, or submit design ideas on our Site, you grant us a non-exclusive, royalty-free, perpetual license to use, publish, and distribute that content.

  • Prohibited Content: You are strictly prohibited from posting reviews or comments that are unlawful, abusive, defamatory, obscene, or infringe on third-party copyrights. We reserve the right to remove any user content at our discretion.

 

9. Limitation of Liability and Warranties

  • "As-Is" Basis: Our website and all products sold through it are provided on an "as-is" and "as-available" basis without any warranties, express or implied.

  • Liability Cap: To the maximum extent permitted by law, The Imaginarium shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your use of the Site or products purchased from it. In no event shall our total liability exceed the amount you paid us for the specific product in question.

 

10. Governing Law & Dispute Resolution

  • Governing Law: These terms and your use of this Site are governed by and construed in accordance with the laws of the State of Wyomiung and the country of USA, without regard to conflict of law principles.

  • Dispute Resolution: Any legal action or dispute arising out of these Terms shall be handled exclusively through binding arbitration / mediation / courts located in Cody, Wyoming.
